By accessing and using the services of Khivaronphak, you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.

2. Acceptable Use

You agree to use our services in a lawful and respectful manner. You must not:

  • Use our services for any illegal or unauthorised purpose
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Interfere with or disrupt our services or website
  • Attempt to gain unauthorised access to our systems
  • Harass, abuse, or harm other students or staff
  • Use our facilities or equipment inappropriately or unsafely
  • Record, photograph, or film classes or other students without permission

We reserve the right to refuse service, terminate accounts, or take appropriate legal action against anyone who violates these terms.

3. Services

We provide Pilates classes, including Mat Pilates, Reformer, and Stretch sessions. All classes are subject to availability and may be modified or cancelled at our discretion.

4. Booking and Cancellation

Class bookings must be made in advance. Cancellations must be made at least 24 hours before the scheduled class time to receive a refund or credit. Late cancellations or no-shows may result in forfeiture of the class fee.

5. Health and Safety

You acknowledge that participation in Pilates classes involves physical activity and may carry inherent risks. You agree to:

  • Inform instructors of any injuries, medical conditions, or limitations
  • Follow all safety instructions and guidelines
  • Participate at your own risk
  • Consult with a healthcare provider if you have concerns about your ability to participate

6. Payment

Payment is required at the time of booking unless otherwise arranged. We accept various payment methods as displayed on our website or at the studio.

7. Refund Policy

Refunds are available in accordance with our Return Policy. Please review that policy for detailed information about refunds and returns.

8. Conduct

We expect all students to:

  • Respect instructors and fellow students
  • Arrive on time for classes
  • Maintain appropriate hygiene
  • Follow studio rules and guidelines

9. Intellectual Property

All content on our website and in our studio, including but not limited to text, graphics, logos, and images, is the property of Khivaronphak and is protected by copyright laws.

10. Limitation of Liability

To the maximum extent permitted by law, Khivaronphak shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability for any claims arising from or related to these Terms or our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law, including under the Australian Consumer Law.

Australian Consumer Law: Our liability is also subject to the consumer guarantees under the Australian Consumer Law. We cannot exclude our liability for failure to comply with consumer guarantees, but we can limit our liability in certain circumstances as permitted by law.

11. Dispute Resolution

If you have any concerns or disputes regarding these Terms or our services, we encourage you to contact us first to resolve the matter amicably. We will make every effort to address your concerns promptly and fairly.

If we cannot resolve a dispute through direct communication, the following dispute resolution procedures apply:

  • Mediation: Before initiating any legal proceedings, both parties agree to attempt to resolve the dispute through mediation with a mutually agreed mediator.
  • Jurisdiction: Any disputes that cannot be resolved through mediation shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
  • Class Action Waiver: You agree that any disputes will be resolved on an individual basis and waive any right to participate in class action lawsuits or representative proceedings.

12. Applicable Law

These Terms of Use are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the courts of New South Wales, Australia.

If you are located outside Australia, you acknowledge that you are using our services at your own risk and are responsible for compliance with local laws in your jurisdiction.

13. Changes to Terms
